Sweepstakes Official Rules

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.
1. Eligibility: This sweepstakes (the “Sweepstakes”) is open only to those who complete the Santa Barbara Magazine 2021 Reader Survey and who are 21 as of the date of entry. The Sweepstakes is only open to legal residents of the United States, and is void where prohibited by law. Employees of Smith Publishing (the “Prize Providers”) their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Sweepstakes.
2. Agreement to Official Rules: By participating, you agree to be fully unconditionally bound by these Officials Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Smith Publishing, as final and binding as it relates to the Sweepstakes. The Sweepstakes is subject to all applicable laws and regulations in the United States.
3. Sweepstakes Period: Entries will be accepted online starting on 29 April 2021 and ending on 31 May 2021. All entries must be received by 31 May 2021 at 11:59PM PST.
4. How to Enter: The Sweepstakes must be entered by submitting an entry using the online form provided on the Santa Barbara Magazine 2021 Reader Survey website. Entries that are not complete or do not adhere to the Official Rules or entry specifications may be disqualified at the sole discretion of Smith Publishing. You may enter the Sweepstakes only once and you must fill in the information requested. You may not enter more times than indicated by using multiple email addresses, identities or devices in an attempt to circumvent the Official Rules. If you use fraudulent methods or otherwise attempt to circumvent the Official Rules then your submission may be removed from eligibility at the sole discretion of Smith Publishing.
5. Prizes: The prizes include a one night stay at Belmond El Encanto (approximate value is $1,600). Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by Smith Publishing. The prize offered to each winner will be selected at the sole discretion of Smith Publishing. The prize does not include travel insurance, the cost of transfers to or from airports or stations, food and drink, spending money, tax or personal expenses (other than as set out above). Any other costs incurred in addition to those set out above and that are incidental to the fulfillment of the prize are the responsibility of the winner. The winner will be responsible for ensuring that he/she and any other person traveling with him/her are available to travel and hold valid passports, any necessary visas and travel documents for the holiday in question on the travel dates specified. The Sponsors reserve the right to substitute the prize (or any part of the prize) with an alternative prize or a cash alternative of equal or greater value. The prize is not negotiable or transferable. Any and all prize related expenses, including without limitation any and all applicable taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by the winner is permitted. Acceptance of the prize constitutes permission for Smith Publishing and the Prize Providers to use the winner's name, likeness, and entry for the purposes of promoting the Sweepstakes and future promotions without further compensation, unless prohibited by law, and the winner will be required to sign a reasonable release in connection with this.
6. Odds: The odds of winning depend on the number of eligible entries received.
7. Winner selection and notification: The winner of the Sweepstakes will be selected in a random drawing under the supervision of the Sponsors. The winner will be notified via email to the email address they used to enter the Sweepstakes within two (2) days following the winner selection. The winner shall have twenty four (24) hours to respond to the email notification, and 14 days to complete an affidavit of eligibility and release form. Smith Publishing shall have no liability for a winner's failure to receive notices due to winner’s spam, junk e-mail or other security settings or for winner’s provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within twenty (24) hours from the time award notification was sent, fails to timely return a completed and executed affidavit confirming the entrant's eligibility to claim the prize, or fails to complete and return a reasonable release form as required in accordance with section 5, the prize shall be forfeited and an alternate winner selected.
The receipt by winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all applicable laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT Smith Publishing’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
8. Rights Granted by you: By entering this Sweepstakes you understand that Smith Publishing and the Prize Providers, anyone acting on behalf of Smith Publishing, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent, to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about the Sweepstakes, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.
9. Terms: Smith Publishing reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Smith Publishing may randomly select the winner (or instruct an independent third party to randomly select the winner) from all eligible entries received prior to and/or after (if appropriate) the action taken by Smith Publishing. Smith Publishing. reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Official Rules.
Smith Publishing has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void any entry for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by sweepstakes rules; or the use of bots, macros or scripts or other technical means for entering.
Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, Smith Publishing reserves the right to seek damages from any such person to the fullest extent permitted by law.
9. Limitation of Liability: In so far as permitted by law, the Sponsors, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of one or more of the Sponsors, its agents or distributors or that of their employees. Your statutory rights are not affected.

11. Winners List: To obtain a copy of the winner's name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: Smith Publishing, 2064 Alameda Padre Serra, Suite 120 Santa Barbara CA 93103 United States. Requests must be received no later than May 31, 2021.
